We may modify, manage, regulate, remove, or eliminate Virtual Items at any time, and they may be lost if your account is closed or the Service is discontinued. Certain game modes (for example, “hardcore”) may cause the loss of in-game items as a designed part of play.
You retain ownership of the content you submit (such as character names and chat messages) (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit your User Content as necessary to operate and provide the Service. You are solely responsible for your User Content and represent that you have the rights to submit it. We may remove User Content that violates these Terms.
The Service and all related materials — including the Halvel and Halvel mini names, the world, lore, art, characters, classes, races, zones, and software — are owned by us or our licensors and are protected by intellectual-property laws. Except for the limited license above, nothing in these Terms grants you any right in our intellectual property.
The Service is provided on an evolving basis. We may add, change, suspend, or discontinue any part of the Service (including features, game balance, and Virtual Items) at any time, with or without notice. We do not guarantee that the Service will always be available, uninterrupted, or error-free, and progress may occasionally be affected by maintenance, updates, or unforeseen issues.
You may stop using the Service and request account deletion at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users. Upon termination, your license ends and your account and associated data may be deleted.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT DATA OR PROGRESS WILL NOT BE LOST.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HALVEL MINI AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR VIRTUAL ITEMS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED USD $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Halvel mini and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any law.
These Terms are governed by the laws of the United States and the State of New York, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in New York, unless applicable law grants you the right to bring proceedings elsewhere. Nothing in these Terms affects mandatory consumer-protection rights you may have.
We may revise these Terms from time to time. We will update the “Last updated” date and, for material changes, provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
